The refund applies to the Full Attorney tier ($2,999 — Cho & Associates) only, and requires a USCIS final denial decision on the merits. A denial issued solely as a matter of USCIS discretion, where the eligibility requirements were met, is not a merit denial and is not covered. A written refund claim must be submitted within 30 days of the date on the USCIS denial notice. The refund does NOT apply when the denial is caused by facts the client concealed from the attorney — including prior criminal record, fraudulent or fabricated documents, prior immigration violations (e.g. overstay, removal, prior fraud allegations), or any other material fact undisclosed during intake. The refund also does not apply to client-initiated withdrawals, abandonment, or refusal to follow attorney advice. RFE responses and post-RFE denials on the merits are covered, subject to the Retainer Agreement. USCIS government fees are non-refundable by law. Yes — in the Full Attorney tier ($2,999), for the standard RFE that USCIS issues for marriage-based cases. We respond within USCIS's deadline and use evidence already in your file. Highly complex RFEs (e.g. fraud allegations) or RFEs arising from facts not disclosed during screening or intake may need a separate scope, which we'll quote transparently before any work. The Limited-Scope tier does not include RFE response.
