Same forms, different category
Both paths use the same core forms — I-130, then I-485 (or consular processing abroad). The difference is the category you fall into:
- Spouse of a U.S. citizen → "immediate relative" (IR). A visa is always available; no waiting line for a visa number.
- Spouse of a permanent resident → preference category F2A. Filing the I-485 depends on the monthly Visa Bulletin.
Timing
Immediate relatives can usually file the petition and green card application together (concurrent filing). F2A spouses can always file the I-130, but the I-485 may need to wait for visa availability — sometimes the wait is short, sometimes the category retrogresses.
Forgiveness for status problems
This is the difference couples feel most. For spouses of U.S. citizens, the law forgives certain problems at the adjustment stage — such as having overstayed a visa or worked without authorization — as long as the entry was lawful. For spouses of permanent residents, those same problems can block adjustment entirely. If there is any status gap in your history, category is the first thing to analyze.
If the LPR spouse becomes a citizen
When a permanent-resident petitioner naturalizes, the case can upgrade from F2A to immediate relative — the waiting line disappears and the more forgiving rules apply. Notify USCIS with proof of naturalization.
FAQ
We married while my spouse had a green card, and now they are a citizen. Do we refile? No — the existing petition can be upgraded; the category changes with proof of naturalization.
Is the interview different? The substance is the same: is the marriage genuine. Category does not change the evidence you need.
Which path is faster? Immediate relative cases avoid the visa-number wait, which is usually the biggest variable. Processing times for the forms themselves are set by USCIS workload either way.
